Terms of Service

1. The Service

WinTheGig (“we”, “us”) provides an AI-powered assistant that helps freelancers draft proposals for platforms such as Upwork (“the Service”). The Service includes a web application and an optional browser extension. By creating an account or using the Service, you agree to these Terms.

2. Accounts

You must be at least 18 years old to use the Service. You are responsible for keeping your login credentials safe and for all activity under your account. You must provide accurate information during registration.

3. Free Credits and Trial

Free accounts receive a limited number of proposal generations. Newly registered accounts also receive a time-limited trial (“Starter Pack”) with additional generation and refinement allowances. Trials and free credits have no cash value, are non-transferable, and may be changed or withdrawn at any time.

4. Subscriptions and Payments

Paid plans are billed through our payment provider (PayPal) as monthly subscriptions or one-time passes, depending on the plan you select. Prices are shown at checkout and include all applicable taxes. You may cancel a subscription at any time; access remains active until the end of the current billing period.

One-time add-ons (e.g. Turbo Refine, Profile Audit, extra credits) are delivered immediately upon payment and are non-refundable.

5. Refund Policy

Due to the digital nature of the Service and the immediate allocation of AI resources, all purchases are final and non-refundable, except where required by applicable consumer law.

6. Acceptable Use

You agree not to:

  • misuse the Service to spam, defraud, or mislead clients or third parties;
  • attempt to bypass usage limits, tamper with credits, trial state, or subscription status, or reverse-engineer the Service;
  • violate the terms of service of third-party platforms (such as Upwork) while using our tools;
  • resell or redistribute the Service or its output as a competing product.

7. What Counts as Abuse

“Abuse” or “misuse” means any use of the Service that harms us, other users, or third parties. In particular, it includes (but is not limited to):

  • Fraud or dishonesty — pretending to be someone else, faking credentials, projects, experience or identities in proposals, or using the Service to defraud clients or platforms.
  • Spam and mass automation — bulk-sending unsolicited proposals, or automating submissions in a way that bypasses platform limits or causes nuisance to others.
  • Technical tampering — any attempt to alter credits, trial or subscription state, manipulate the client, APIs or payment verification, or probe or attack our infrastructure.
  • Illegal content — using the Service to produce or distribute content that violates the law, or material that is defamatory, discriminatory or otherwise harmful.
  • Harmful automated use — repurposing the Service's output or access in ways that misrepresent its origin, bypass platform rules, or cause harm to other freelancers.

Where these Terms give examples, they are illustrative — abuse is judged by its real-world impact, not only by whether it fits an example exactly.

8. Bans and Suspensions

If we determine, at our reasonable discretion, that your account has been used in ways described in Section 7, or otherwise breaches these Terms, we may:

  • suspend your access temporarily (a “ban”), or
  • terminate your account permanently.

A temporary ban blocks all use of the Service for its duration. You will be told the end date and the reason for the ban when you try to access the Service. Bans are applied server-side and cannot be bypassed from the client.

Repeated or severe abuse leads to a permanent termination. Where required, we may also report unlawful activity to the relevant authorities or platforms.

If you believe a ban was issued by mistake, contact support@winthegig.com and we will review the decision.

9. AI-Generated Content

Proposals are generated by machine-learning models and are provided as drafts. Output may be inaccurate or incomplete. You are solely responsible for reviewing, verifying, and editing any generated content before sending it, and for complying with the rules of any platform where you submit it. We make no warranty that generated content is factually correct or free of third-party rights.

10. Intellectual Property

All rights to the Service, its design, code, and branding belong to WinTheGig. Subject to these Terms, generated proposal texts are yours to use for your own job applications.

11. Disclaimers and Limitation of Liability

The Service is provided “as is” without warranties of any kind, including availability, accuracy, or fitness for a particular purpose. To the maximum extent permitted by law, WinTheGig shall not be liable for indirect, incidental, or consequential damages, including lost income or lost business opportunities arising from the use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Termination

We may suspend or terminate accounts that violate these Terms, at our discretion. You may delete your account at any time from the application settings.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on the website or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
